This prescription and/or pharmaceutical discount card program (“Card“) and related services (the “Services“) are made available to you by PHC Insurance Agency, LLC, an Arizona limited liability company (“PHC“, “we“, “us“, and “our“). This Privacy Policy describes our policies on the collection, use, and disclosure of information about you in connection with your use of the Services, which may occur via the associated website, www.petgeniusrx.com (“Website”). When you use the Website or any component of the Services, you consent to our collection, use, and disclosure of information about you as described in this Privacy Policy. If you do not consent to the collection, use, and disclosure of your information as set forth below, you may not access or use the Website or Services. Any capitalized term not defined in this Privacy Policy has the meaning given that term in the Terms of Service or Terms of Conditions (“collectively, “Terms of Service”).

Modifications to this Privacy Policy

We may, at our sole discretion, revise this Privacy Policy from time to time. The most current version of the Privacy Policy will be made available to you on the Website. We encourage you to periodically review this Privacy Policy. If we make material changes to this Privacy Policy, we will notify you on the Website by posting a conspicuous notice prior to the effective date of the changes. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy. If you do not agree to the revised Privacy Policy, you may terminate your account as set forth in the Terms of Service.

International Users

PHC is based in the United States and the Services are hosted in the United States. If you are accessing the Services from outside the United States, by providing your information to PHC and using the Services, you hereby consent to the transfer of your information to the United States for processing, storage, and maintenance in accordance with this Privacy Policy and our Terms of Service. You are also consenting to the application of United States law in all matters concerning the Services.

Information We Collect and Your Choices on How We Use It

You may visit the Website and obtain and use the basic discount Card without providing us any personally identifiable information, although we will collect non-personally identifiable information regarding your visit as set forth below. In order to access and use certain additional features of the Services, we require you to provide us with certain information to create an Account as contemplated in the Terms of Service.

We collect and use the following information:

Account Information: If you register to create an Account, we require you to submit your first name, last name, date of birth, email, and zip code. We will also collect any other information that you choose to submit in connection with your Account. You cannot opt out of receiving communications from PHC that are administrative or legal notices related to your Account, the Website, or the Services.

User Activity: We (or our third-party vendors on our behalf) may collect information about your use of the Services such as your user activity, the pages you view, and the date, time and duration of your activity.

General Internet Information: We also may collect and store information that your computer or mobile device provides to us in connection with your use of the Services and Website, such as your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, unique device identifier (e.g. Google Advertising ID (GAID), Android ID, ID for Advertisers (IDFA), ID for Vendors (IDFV), MAC address, International Mobile Equipment Identity (IMEI), or other device IDs), location, requested and referring URLs, and other information about your device(s), operating system, and the state or country from which you accessed the Services. We use this information for marketing purposes and to understand how you interact with the Services.

Location Information: In order to enhance your user experience and increase the usefulness of the Services, with your consent, we may access your location. PHC will only access your location while you are using the Website and provided you have opted in to activate this feature. You may choose to allow PHC to access your location by granting the Website, as applicable, access to your device’s location when prompted or through your device’s location services settings. You may also provide us with a zip code when using the Website.

PHC uses the Google Places API(s) for location searches and as a result is using the Google Maps/Google Earth API(s). Pursuant to the Google Maps/Google Earth APIs Terms of Service, use of this location feature is also subject to the Google privacy policy, which can be found at https://policies.google.com/privacy, and is incorporated with this reference.

The Google Display Network Impression Reporting uses the Google Analytics cookie to track our ad impressions and your interactions with those impressions, including the effectiveness of those ads, which generates reports for us to help us analyze our advertisements. Remarketing with Google Analytics uses the Google Analytics cookie to serve advertisements to you across the Internet based on your visit to our Web Site. Social Media: The Services may allow you to connect and share information with Facebook. This feature may require us to implement cookies, plug-ins, and APIs provided by such social media platform to facilitate the communication. We may share information that you provide us or that we may collect about your use of the Website with Facebook, which information becomes subject to Facebook’s Data Policy.

In addition, by choosing to use any third-party social media platform or choosing to share content or communications with any social media platform, you allow us to share information with the designated social media platform. PHC cannot control any policies or terms of such third-party platform. As a result, we cannot be responsible for any use of your information or content by a third-party platform, which you use at your own risk.

If you do not wish a social media platform to collect information relating to you via the Services, we suggest that you: (a) do not connect to or share information with that social media platform using the Services; (b) hide social media platform plug-ins using an ad blocker; (c) always log off completely from the social media platform before visiting other websites and delete all related cookies; and, (d) where the option made available by the social media platform, disable the advertising services and networks operated by that platform.

Online Health Initiative Survey: We may collect survey information from time to time. We may use all of the survey information that we collect for our internal business purposes. We may also aggregate and anonymize any survey information and license and distribute the same.

In addition to the purposes set forth above, we use the information we collect for the purpose for which it was provided (for example, to fulfill your requests) and to provide the Services, improve the performance and quality of the Website, personalize your experience, track usage of the Services, provide feedback on the Services, provide customer support, communicate with you about your Account and use of the Services, back up our systems and allow for disaster recovery, enhance the security of the Services, and comply with our legal obligations.

How We Use and Share Collected Information

Evaluation and Improvement of Our Services. We may use and disclose collected information: to analyze, develop, and improve the content, materials, products, and services that we make available (including the Services and Website); to inform marketing and communication plans and strategies; to understand Website demographics and user preferences; and to evaluate Website user needs and customize Website content, promotional emails, and users’ browsing experience.

Our Suppliers: We contract with a number of service providers and vendors that will have access to your information as necessary to provide the Services or Website. These service providers and vendors may include, but are not limited to, our third-party marketing and ad agencies, our information technology vendors, and our customer service call center vendors. Information shared may include but is not limited to your personally identifiable information, the analytics tools discussed above, and other analytic tools used to report information to us should we experience technical issues with the Website or the Services or for various other purposes related to providing the Website or the Services. Our service providers may also aggregate the information they receive for their own internal analysis and purposes and for inclusion in general databases regarding consumer behavior and trends as described above. For information on interest-based advertisements that are specifically targeted to you, you may opt out of individual ad networks as set forth above.

Sale or Transfer of Business or Assets: If we are sold or disposed of as a going concern, whether by merger, reorganization, sale of assets or otherwise, or in the event of an insolvency, bankruptcy or receivership, any and all personally identifiable information, including your Account information may be one of the assets sold or merged in connection with that transaction. Information about you may also need to be disclosed in connection with a commercial transaction where we or any one of our businesses are seeking financing, investment, support, or funding. In such transactions, personal information will be subject to the promises made in any pre-existing Privacy Policy in effect when the information was obtained.

Do Not Track

We will automatically collect cookies and other non-personally identifying information when you visit the Website. Due to this automatic collection, we do not currently honor “do not track” requests. We currently participate in third-party ad networks and use third-party cookies as discussed above to track your visits across websites.

Data Retention and Account Termination

You can close your account by emailing us through our website at petgeniusrx.com. We will remove your Account from active status, but we may retain information about you for the purposes authorized under this Privacy Policy unless otherwise prohibited by law.

The Services may contain links to unaffiliated third-party websites. We have no responsibility or liability for such third-party websites and do not endorse the same. Except as described in this Privacy Policy, we do not share your personal information with them, and are not responsible for their privacy practices. Children

The Services are not directed or intended for children under 13 years of age. We do not knowingly collect personal information from children under 13.

Security

Your privacy and the security of your information is very important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it, including two-factor authentication for access to your Account and SSL encryption for data transmission. However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
